General Warranty Conditions
FOR LIGHTING PRODUCTS BY CEZOS LIMITED LIABILITY COMPANY LIMITED PARTNERSHIP
1. Definitions used in the document:
1.1. Guarantor - Cezos Limited Liability Company Limited Partnership registered under KRS number 0000585942 and holding NIP number 5860018456 and REGON 190273058, headquartered in Gdynia at 88b Olgierda Street.
1.2. Buyer – any entity that purchases products from the Guarantor.
1.3. Warranty – the Guarantor's obligation to the Buyer to repair or replace the product, whose defects appeared during the warranty period.
1.4. Territorial Scope of the Warranty – The Warranty is valid within the territory of the Republic of Poland unless a broader scope of the Warranty is individually agreed in writing under penalty of nullity.
2. General Conditions
2.1. The Guarantor provides a Warranty for products offered by CEZOS under the terms described in this document.
2.2. The Guarantor guarantees that if the products covered by the warranty are operated in accordance with their usage principles and intended purposes, they will function properly for at least the duration of the warranty protection, subject to the reservations described in this document.
2.3. The Guarantor provides a 2-year warranty for Cezos products.
2.4. The Guarantor allows for the possibility of extending the warranty beyond 2 years, depending on the specifics of the products or the circumstances surrounding the order. However, this requires a written declaration from the Guarantor under penalty of nullity each time.
3. Terms
3.1. The warranty period starts from the date the goods are issued to the Buyer.
4. Warranty Exclusions and Limitations
4.1. The warranty covers only manufacturing defects and defects caused by product-inherent reasons, i.e., hidden defects resulting from manufacturing flaws or hidden material defects, as well as product defects due to design, material, or manufacturing errors.
4.2. The warranty applies only if the products have been used according to their intended purpose and installed according to the conditions specified in the catalogs, brochures, instructions, and professionally by qualified personnel with appropriate certifications. The total lighting time of the fixtures per year must not exceed 4,300 hours.
4.3. Products covered by the Warranty must not be exposed to any mechanical or chemical overloads, and the ambient temperature and supply voltage must not exceed the nominal values.
4.4. Violating the principles mentioned in points 4.2 – 4.3, and others listed in this document, will result in the loss of warranty rights.
4.5. The following does not constitute a defect:
4.5.1. natural wear and tear of materials used, e.g., yellowing of covers, dulling of paint coatings, discoloration due to the passage of time or exposure to atmospheric conditions,
4.5.2. reduction of light output during the product’s lifespan by up to 0.6%/1000h,
4.5.3. color change of LED modules,
4.5.4. changes in light output, color temperature, and efficiency of new LED modules within a tolerance of +/- 10%.
4.6. The warranty does not cover defects arising from external causes, including but not limited to:
4.6.1. normal wear and tear,
4.6.2. improper use of products,
4.6.3. actions of third parties, particularly installers using the products covered by the warranty,
4.6.4. force majeure,
4.6.5. exposure to chemical, thermal, mechanical, light, and other factors whose effect on the products is contrary to the user instructions, technical knowledge, or common sense,
4.6.6. improper maintenance or storage,
4.6.7. modifications, alterations, or repairs made by unauthorized service providers.
4.7. The Guarantor reserves the right to assess and qualify the defect.
4.8. The Guarantor does not cover any additional costs or damages related to the occurrence of the defect.
4.9. The Guarantor's liability is limited to the value (purchase price) of the defective product.
4.10. The warranty does not cover costs of dismantling, installing the defective product, or any damages related to the need for dismantling, delivery, installation, or temporary inability to use the product.
5. Reporting a Defect
5.1. The existence of a defect should be reported using the warranty claim form, which is available on the website www.cezos.com – under the "Downloads" tab.
5.2. The customer reporting the complaint is required to complete the warranty claim form and send it by email to reklamacje@cezos.com, cezos@cezos.com, or directly to the Guarantor's headquarters.
5.3. A condition for the warranty claim to be considered is documentation of the purchase and date of purchase of the defective product with a VAT invoice or fiscal receipt and a detailed description of the identified defect.
5.4. The date of defect reporting is considered to be the day the information actually reaches the Guarantor.
6. Handling the Warranty Claim
6.1. The Buyer is obliged to deliver the defective product to the Guarantor's headquarters unless the Guarantor decides that it is reasonable to inspect and examine the product at its installation site.
6.2. In the case of inspecting and examining the product at its installation site, the Buyer must provide the Guarantor or persons authorized by the Guarantor access to the defective product for inspection and defect removal. The Buyer's failure to provide access to the defective product to the Guarantor at the agreed time is considered a release of the Guarantor from warranty obligations.
6.3. If the claim is found to be justified under the Warranty, the Guarantor will cover the delivery costs, provided that the Buyer contacts the Guarantor's warranty department (email: reklamacje@cezos.com, cezos@cezos.com) and obtains approval for the proposed delivery method and costs.
6.4. If the warranty claim is found to be unjustified or not covered by the Warranty, the Buyer is responsible for collecting the product from the Guarantor's headquarters. If the product is not collected by the Buyer after being notified by the Guarantor, the Buyer will be responsible for covering storage costs or the costs of returning the product. If storage takes place in the Guarantor's warehouses, the storage costs will be no less than 1.0% of the value of the stored goods per month, starting from the date of storage.
6.5. In the event of an unjustified warranty claim, the Buyer agrees to reimburse the Guarantor for all labor and travel costs of personnel engaged by the Guarantor to check the validity of the claim.
6.6. The Guarantor processes the warranty claim within 14 business days of receiving the defective goods or being granted access for inspection. If additional information related to the defect or product usage is needed during the complaint review process, the Buyer must provide all necessary data and information. The warranty will be processed within the specified timeframe; however, if the claim requires detailed technical analysis, the duration of these tests will automatically extend the complaint review period, and the Guarantor will inform the Buyer accordingly.
6.7. If the claim is found to be justified, the Guarantor, at its own discretion:
6.7.1. replaces the defective product with a new one free of defects or
6.7.2. provides a free repair of the defective product, or
6.7.3. refunds the Buyer the purchase price of the defective product.
6.8. The Guarantor decides how the warranty claim will be resolved.
6.9. If component replacement occurs due to a valid claim, the warranty does not reset, except in cases where the replacement is substantial or when the entire product is replaced with a defect-free product.
6.10. The Guarantor allows for the use of replacement components in the complained products.
6.11. During defect inspection, defects may be directly resolved, provided it is technically feasible.
7. Other Conditions
7.1. A condition for using the Warranty is the Buyer's possession of the purchase document (invoice/receipt).
7.2. The Buyer loses warranty rights if the products are connected to an installation that does not have a permanently built-in overload protection device in the LED lighting circuit.
7.3. The Warranty cannot be transferred to third parties.
